§ 1 Scope

These Terms and Conditions apply to all orders placed by consumers (§ 13 BGB) via our online shop at ice-white.com with Maximilian Parenza & Zio Tristan Mundry GbR (hereinafter “we” or “us”).

§ 2 Contractual Partner, Conclusion of Contract

(2) The presentation of products in the online shop does not constitute a legal binding offer, but an invitation to place an order. The contract is concluded when the customer places a binding order via the “Buy Now” button and we confirm this order by e-mail or by shipping the goods.

§ 3 Prices and Shipping Costs

(1) All prices include statutory VAT (if we are subject to VAT) plus shipping costs.
(2) Shipping costs are shown separately in the ordering process.

§ 4 Delivery

(1) We deliver within Germany and, if applicable, to other countries.
(2) The delivery time is usually 2-5 working days.
(3) If a product is not available, we will inform the customer immediately and refund any payments already made.

§ 5 Payment

Payment is made either by PayPal, credit card, instant transfer, or other payment methods offered in the shop.

§ 6 Retention of Title

The goods remain our property until full payment has been made.

§ 7 Right of Withdrawal

Consumers have a statutory right of withdrawal.

To exercise the right of withdrawal, the consumer must inform us

by means of a clear declaration (eg a letter sent by post, fax, or e-mail) of the decision to withdraw from this contract.

§ 8 Warranty

The statutory liability for defects applies to the items offered.

§ 9 Liability

(1) We are fully liable for damages resulting from injury to life, body, or health as well as for intentional or grossly negligent breach of duty.
(2) In the event of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, contract-typical damage.
(3) Otherwise, liability is excluded.

§ 10 Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 11 Final Provisions

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
If individual provisions of these Terms and Conditions are invalid, the validity of the remaining provisions shall remain unaffected.
